A Cordele man convicted of hiring a hit man who murdered the wrong man is appealing his conviction to Georgia's State Supreme Court.

In 2015, a Houston County judge sentenced Devasko Lewis to life without parole in state prison for murder and other charges.

He was acccused of hiring the hit man to kill his business partner, whom he believed planned to testify against him in a federal fraud case.

Instead, prosecutors say hit man Jamarcus Clark murdered the partner's nephew, Kerry Glenn in January 2014, in Houston County.

Clark is also serving a life sentence for murder.

Lewis's lawyers argue that he was convicted solely on Clark's testimony and that other witnesses contradicted his statements.

Clark later wrote a letter to defense lawyers saying that he lied on the stand, according to a court summary of the case.

Prosecutors argue that there's no proof Clark lied and that other evidence backed up his testimony.

The state's supreme court is scheduled to hear arguments on the case Tuesday in Atlanta.
