The U.S. Equal Employment Opportunity Commission has filed a lawsuit against the operator of a Kentucky Fried Chicken franchise in Dublin on behalf of a former manager.
A news release from the EEOC about the lawsuit alleges the operator, Hester Foods, Inc., violated federal law by discriminating against an employee because of a disability.
According to the lawsuit, the unnamed restaurant owner violated the Americans with Disabilities Act (ADA) when they fired manager Cynthia Dunson in July 2015 after finding out she was on prescribed medicine for bipolar disorder.
The suit says the owner referred to the medicine in obscene terms and forced her to destroy the medicine by flushing the pills down the toilet. When Dunson said she would continue taking the medicine, the owner fired her.
The EEOC says they filed the suit after an unsuccessful attempt at reaching a pre-litigation settlement.
They are seeking back pay, compensatory and punitive damages for Dunson, and ‘injunctive relief’ to prevent future discrimination.
