Defense rests in Tex McIver murder trial | Defendant speaks for the first time

Closing arguments could begin as soon as Monday, and deliberations will start immediately afterward.

ATLANTA – Closing arguments could begin as soon as Monday in the high-profile murder trial of Tex McIver, the Buckhead attorney who is accused of intentionally killing his wife, Diane, almost a year and a half ago.

The defense rested its case Friday afternoon, which was day 19 in the trial.

Friday also marked the first time McIver spoke on the record in court, when he told Fulton County Superior Court Judge Robert McBurney he was not going to testify.

McBurney also rejected defense motion's for a mistrial based on the testimony of McIver confidant Bill Crane.

On September 25, 2016, the McIvers were riding in an SUV. Tex McIver was in the back seat behind his wife with a loaded handgun he says was on his lap. He has admitted to the fatal shooting, but said the incident was “a horrible accident.” Prosecutors contend Tex McIver killed his wife because he needed money from her estate.

Friday’s testimony began with state Rep. Mary Margaret Oliver (D-Decatur), an attorney who is the executor of Diane McIver’s estate.

Jurors also heard testimony from crime scene investigation expert Ross Gardner, who said that in his examination of the shooting, Tex McIver’s arm could not have been down by his hip to fire the handgun that killed his wife.

Gardner also said the gun could have been laying sideways in Tex McIver’s lap. He also criticized how police handled certain parts of the crime scene investigation.

Court resumes at 9 am Monday.
