Suspects Plead Not Guilty in Gail Spencer Murder

Two of the suspects in last October's killing of legal secretary Gail Spencer pleaded not guilty to malice murder and other charges.

Prosecutors say Tracy Michelle Jones and Michael Brett Kelly suffocated Spencer at her home on Stinsonville Road. They believe Spencer was killed as part of an embezzlement plot against the Macon law office where she worked.

District Attorney David Cooke says, based on the evidence in the case, he's decided to try Kelly first. 

Jones and Kelly are each charged with malice murder, three counts of felony murder, aggravated assault, 1st degree burglary, false imprisonment, and theft by taking.

The state is seeking the death penalty in both cases.

Superior Court Judge Tillman Self set deadlines for both sides to submit motions.  He said he wanted to be begin the trial process as soon as possible. 

So far, there's no specific date set yet, but Kelly's trial is expected to start sometime early next year.
