In late December, police said suspect Ashley Brown was the 'primary aggressor' in the shooting, but that they did not think he fired the fatal shots.
Brown has also been charged with two counts of aggravated assault for wounding two others at the diner.
The US Marshals' Southeast Regional Fugitive Task Force served the warrant on Haywood early Wednesday morning.
