Macon Murder Trial Gets Under Way Today

Testimony is scheduled to begin Tuesday for a 29-year-old Lizella man accused of killing a convenience store clerk three years ago.

Maurice Battle is one of three people charged in the shooting death of Dipak "Danny" Patel at the Riverside Drive Chevron Station near the intersection of College Street.

District Attorney Greg winters said Battle's charged with malice murder, felony murder, armed robbery, aggravated assault and possession of a firearm during the commission of a crime.

Winters said he expects the trial to last through Wednesday. Prosecutors originally said they'd seek the death penalty in the case.

But Winters said the death penalty is off the table now.

Two other Macon men, Korey Stephens and Richard Harris, were indicted on murder charges along with Battle. Both men pleaded guilty to murder and have been sentenced to 20 years in prison.

They may testify during Battle's trial.
