Macon man asks Georgia Supreme Court to throw out his murder charges

He claims to have killed a man in self-defense, but prosecutors say he was on probation as a first time felony offender and shouldn't have had a gun

MACON, Ga. — A Macon man is asking the state's Supreme Court to throw out murder charges against him.

According to the court, Frederick Johnson Jr. argues that in June 2016, he shot Tyrell Johnson in self-defense.

But Bibb County prosecutors say Johnson was on probation four years ago as a first-time felony offender and should NOT have had a gun.

They say that makes him ineligible to claim self-defense.

Johnson's lawyers asked a Bibb County judge to throw out his indictment before trial, but they refused.

The state court is scheduled to hear Johnson's case Tuesday in Atlanta.

In June 2016, Frederick Johnson Jr. moved into his girlfriend, Tranzey Johnson’s (no relation), apartment in Macon despite Tranzey’s ex-boyfriend objecting.

The ex-boyfriend, identified as Tyrell Jordan, came over and confronted the two. Jordan grabbed Johnson as he was coming out of the bathroom and pushed him onto an air mattress.

Johnson pulled out a Glock and fired two shots as he was being beaten by Jordan.

Jordan later died from his wounds and Johnson later turned himself in.
