Grandparents found guilty in international kidnapping case

Dr. Chris Brann has been fighting for five years to bring his young son home after his former wife took him to Brazil for a wedding and never returned.

The couple accused in the international kidnapping case involving their grandson was found guilty Friday morning in a Houston courtroom.

Jurors found Carlos and Jemima Guimaraes guilty of kidnapping but not guilty of conspiracy.

Prosecutors said the couple helped their daughter Marcelle kidnap their grandson in 2013 and take him from Houston to Brazil.

Marcelle Guimaraes took Nico to her native Brazil for a wedding and never returned.

Her ex-husband, Dr. Chris Brann, has been fighting for five years to bring his son home. He released the following statement Friday.

"Today is an incredibly sad day for me. All I have ever wanted is for Nico to have equal access to his two loving parents. Yet the Guimarães' not only premeditated his abduction to Brazil but have for years done everything possible to both cut me off from Nico and poison his relationship with me. Despite all the cruelty they have heaped on my extraordinary son Nico by obstructing his relationship with me, Nico remains my sole concern. If my ex-wife Marcelle returns with Nico to the United States immediately, I will happily appear at the Guimarães' sentencing hearing to advocate maximum leniency before Judge Alfred Bennett."

Brann's attorney also issued a plea to Nico's mother to return him to the United States.

"I take no joy in the verdict convicting the Guimarães' today because Nico Brann remains in Brazil and continues to be almost totally cut off from access to his loving father. All that matters is getting Nico back to the United States - but we are no closer to achieving that goal, Jared Genser said. "I hope that Marcelle Guimarães loves her parents deeply and appreciates that their only hope for reducing their jail time is returning Nico to the United States."

Defense attorney Rusty Hardin said he and his team were crushed by the verdict.

They had argued Marcelle Guimaraes was a victim of abuse who took Nico to protect him.

"These are two of the nicest, most incredibly supportive, good people that I can imagine," Hardin said. "And I don't know what a grandparent is expected to do in this circumstance if they believe their daughtetr is the victim of domestic violence."

Carlos and Jemima Guimaraes will remain under house arrest at their son's home and must wear ankle monitors while awaiting sentencing.

They could face up to three years in prison, along with fines.
